Terms and Conditions

The vendor table is $15 a day, we operate every Saturday June 24-Sept 9th from 9 AM -1 PM

Vendors whose applications are accepted will be contacted with information regarding setup.

**APPLICATION DOES NOT MEAN ACCEPTANCE**

If for any reason your application is not accepted after you have issued any funds you will be issued a refund.

VENDOR MUST SUPPLY OWN TABLE, CHAIRS AND TENT AND ADHERE TO LOCAL, STATE, AND FEDERAL COVID-19 GUIDELINES

VENDOR hereby contracts with The city of Elyria, Elyria Community Partnership for space on Ely Square follows:

1. VENDOR agrees to use booth space as described. VENDOR agrees to accept space assigned and will not sub-let to anyone else.

2. The Elyria Community Partnership, the City of Elyria, or any participants or sponsors, will not be responsible for any injury which may arise to VENDOR, their employees, agents, guests or customers; or for the loss, theft of or damage to any food, display, merchandise, samples or vehicle from any cause whatsoever while in transit to or from, or while participating in the Elyria Community Partnership. By executing this contract, VENDOR agrees absolutely and irrevocably to waive and release any claim it may have against the Elyria Community Partnership, the City of Elyria, or any participants or sponsors, their officers, officials, agents or employees.

3. When “ACTS OF GOD” or any other causes not within the control of the Elyria Community Partnership, the City of Elyria, Invest Elyria, or any affiliated entity, make it impossible for the VENDOR to occupy the Festival premises, then in such case the Elyria Community Partnership, and any committees, etc., their officers, officials, agents or employees are jointly released from any and all claims for damages which may arise as a consequence thereof.

4. The VENDOR also agrees to the following conditions of this contract:
a. NON-FOOD VENDOR: Set up shall be completed between 2:00-3:45pm pm the day contracted.
FOOD VENDOR: Set up and ready for health department inspection shall be completed by 3:00 pm.
b. Vendors need to make arrangements to use individual generators.
c. Only food specified in contract may be sold.
d. Booth sharing by VENDORS is NOT permitted unless otherwise directed.
e. The VENDOR agrees to use qualified labor at all times.
f. The management shall be entitled to close an exhibit at any time for failure of VENDOR to perform, observe and comply with any term set forth in the contract.
g. VENDOR shall not be entitled to a refund or any part of any fee should he/she, for any reason, is unable to participate after acceptance.
h. If, for any reason, the management determines that the location of the Food Vendors should be changed or dates should be changed, management reserves this right.
i. All pertinent laws, ordinances and regulations pertaining to health and public safety shall be strictly observed.
j. VENDORS shall have appropriate license, insurance, and local health department permit.
k. VENDOR will cooperate by keeping area clean.
l. VENDOR will not leave, load out, or close booth for business before 9pm unless otherwise authorized.
m. The number of food vendors will be limited by their menu. Applications will be reviewed as received and accepted or rejected at the discretion of the Elyria Community Partnership or City of Elyria.
n. VENDOR will provide own table covering.
o. All electronic signatures are deemed BINDING for purposes of this contract.
